Conditions of participation and privacy policy for online sweepstakes

 

1 Scope of application

1.1 These Terms and Conditions of Participation apply to all competitions organised by WEPA Professional GmbH (hereinafter referred to as the "Organiser"). By participating in the competition, each participant recognises these Terms and Conditions of Participation and Privacy Policy.

1.2 For reasons of readability, only the masculine form is used. All personal designations apply equally to both genders.

 

2 Eligibility to participate

2.1 Eligibility is open to all natural persons acting in their own name and who are at least 18 years old.

2.2 Employees of WEPA and affiliated companies are excluded, as are relatives of such employees and their direct relatives. Participation with falsified identities or with identities of third parties is not permitted. Each participant may only take part in the sweepstakes once. 

2.3 The Organizer reserves the right to exclude individuals who violate these terms and conditions or gain an unfair advantage through manipulation of the sweepstakes. In such cases, the Organizer may also disqualify participants after the fact, revoke their winnings, and reclaim them.

 

3 Execution of the sweepstakes

3.1 The sweepstakes will be conducted from April 14, 2026, to April 17, 2026. The winner will be determined by random draw from among all eligible participants within one week after the closing date and will be contacted by us via email. Each notified participant must inform the Organizer within 14 days of the notification whether they accept the prize; otherwise, the opportunity to accept the prize will be forfeited. Changes or cash alternatives to the prize are excluded. The prize is non-transferable.

3.2 The Organizer is liable for damages to the winner due to defects in goods and/or legal defects only in cases of deceit, intent, or gross negligence. Apart from these cases, liability for defects in goods and/or legal defects is excluded. This does not apply to injuries to life, body, and health, claims under the Product Liability Act, or in any other case where a limitation of liability is not permissible under mandatory legal provisions.

3.3 The Organizer is entitled to terminate, adjust, or modify the sweepstakes at any time without prior notice and without stating reasons if proper execution of the sweepstakes cannot be ensured due to technical or legal reasons.

 

4 Miscellaneous

4.1 Legal recourse is excluded.

4.2 Only the law of the Federal Republic of Germany shall apply. For consumers, this choice of law applies only to the extent that the protection provided by mandatory provisions of the law of the state in which the consumer has his habitual residence is not withdrawn.

4.3 Should any of these terms and conditions be or become invalid, the validity of the remaining terms and conditions shall remain unaffected.

 

5 Privacy

is responsible for data processing related to the sweepstakes

5.2 We process your personal data only for the proper execution and handling of the sweepstakes and for sending the prize.

To conduct the sweepstakes, the first and last name and the email address of each participant are collected and stored. For sending the prize, we additionally collect the address from the winners and pass this data on to a shipping company we have commissioned. No further transfer of your data to third parties takes place.

The legal basis for this processing of your personal data is Art. 6 para. 1 lit. b GDPR (implementation of pre-contractual measures and fulfilment of a contract).

5.3 After the sweepstakes ends, your personal data processed in the context of the sweepstakes will be deleted no later than three months after the end of the sweepstakes, unless a valid consent for further processing exists and/or there is a legitimate interest in further storage on our part.

5.4 Applicable data protection law grants the following rights to affected individuals:

Right of access according to Art. 15 GDPR: 

Participants have a right to access information about their personal data processed by us, the purposes of processing, the categories of personal data processed, the recipients or categories of recipients to whom their data has been or will be disclosed, the planned duration of storage or the criteria for determining the duration of storage, the existence of the right to rectification, erasure, restriction of processing, objection to processing, to lodge a complaint with a supervisory authority, the source of your data if not collected from you by us, the existence of automated decision-making including profiling, and, if applicable, meaningful information about the involved logic and the scope and intended effects of such processing, as well as your right to be informed about the guarantees under Art. 46 GDPR when your data is transferred to third countries.

Right to rectification according to Art. 16 GDPR: 

Participants have a right to immediate rectification of incorrect data concerning you and/or completion of your incomplete data stored by us.

Right to erasure according to Art. 17 GDPR: 

Participants have the right to request the erasure of their personal data if the requirements of Art. 17 para. 1 GDPR are met. However, this right does not exist in particular if the processing is necessary for exercising the right of freedom of expression and information, for compliance with a legal obligation, for reasons of public interest or for the establishment, exercise or defence of legal claims.

Right to restriction of processing according to Art. 18 GDPR:

Participants have the right to request the restriction of the processing of their personal data for as long as the accuracy of their data, which they dispute, is being verified, if they refuse to have their data erased due to unauthorised data processing and instead request the restriction of the processing of their data, if they require their data for the establishment, exercise or defence of legal claims after we no longer need this data after the purpose has been achieved or if they have lodged an objection for reasons relating to their particular situation, as long as it is not yet clear whether our legitimate reasons prevail.

Right to notification according to Art. 19 GDPR::

If a participant has asserted the right to rectification, erasure or restriction of processing against the controller, the controller is obliged to notify all recipients to whom the personal data concerning you have been disclosed of this rectification or erasure of the data or restriction of processing, unless this proves impossible or involves a disproportionate effort. Participants have the right to be informed about these recipients.

Right to data portability according to Art. 20 GDPR:

Participants have the right to receive your personal data that you have provided to us in a structured, commonly used and machine-readable format or to request that it be transmitted to another controller, where technically feasible.

Right to withdraw consent granted according to Art. 7 para. 3 GDPR:

Participants have the right to withdraw their consent to the processing of data at any time with effect for the future. In the event of revocation, we will delete the data concerned immediately, unless further processing can be based on a legal basis for processing without consent. The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal. Participation in the competition is no longer possible after withdrawal.

Right to lodge a complaint according to Art. 77 GDPR:

If a participant believes that the processing of their personal data infringes the GDPR, they have the right - without prejudice to any other administrative or judicial remedy - to lodge a complaint with a supervisory authority, particularly in the Member State of their residence, place of work, or place of the alleged infringement.
