Conditions of participation and privacy policy for online competitions

 

1 Scope of application

1.1 These Terms and Conditions of Participation apply to all competitions organised by WEPA Professional GmbH (hereinafter referred to as the "Organiser"). By participating in the competition, each participant recognises these Terms and Conditions of Participation and Privacy Policy.

1.2 For reasons of readability, only the masculine form is used. All personal designations apply equally to both genders.

 

2 Eligibility to participate

2.1 Any natural person aged 18 or over and resident in Germany is eligible to participate in their own name.

2.2 Employees of WEPA and affiliated companies are excluded, as are relatives of such employees and their direct relatives. Participation with falsified identities or with identities of third parties is not permitted. Each participant may only take part in the competition once. 

2.3 The organiser reserves the right to exclude persons from participation who violate these conditions of participation or who gain an advantage over other participants by manipulating the competition. In such cases, the organiser may also subsequently exclude participants from the competition, withdraw prizes and reclaim them.

 

3 Realisation of the competition

3.1 The competition will be held in the period from 11 March 2024 to 22 March 2024. The winner will be selected at random from all eligible participants within one week of the closing date and contacted by email. Each participant notified in this way is obliged to inform the organiser within 14 days of the notification being sent whether they accept the prize, otherwise the possibility of accepting the prize will lapse. A change or cash payment of the prize is excluded. The prize is non-transferable.

3.2 The Organiser shall only be liable for damages incurred by the winner due to material defects and/or defects of title in the event of malice, intent or gross negligence. Otherwise, liability for material defects and/or defects of title is excluded. This does not apply to injury to body, life and health and claims under the Product Liability Act, as well as in any other case in which a limitation of liability is not permissible due to mandatory statutory provisions.

3.3 The Organiser is entitled to terminate, adapt or modify the competition prematurely at any time without prior notice and without giving reasons if the proper execution of the competition cannot be guaranteed without appropriate measures for technical or legal reasons.

 

4 Miscellaneous

4.1 Legal recourse is excluded.

4.2 The law of the Federal Republic of Germany shall apply exclusively. In the case of consumers, this choice of law shall only apply insofar as the protection afforded by mandatory provisions of the law of the country in which the consumer has his habitual residence is not withdrawn. 

4.3 Should individual provisions of these Terms and Conditions of Participation be or become invalid, this shall not affect the validity of the remaining Terms and Conditions of Participation.

 

5 Data protection

5.1 Responsible for data processing in connection with the competition is

5.2 We process your personal data only for the proper organisation and handling of the competition and for sending the prize.

The first name, surname and email address of the respective participant will be collected and stored in order to organise the competition. To send the prize, we also collect the address from the winners and pass this data on to a shipping company commissioned by us. Your data will not be passed on to third parties beyond this.

The legal basis for this processing of your personal data is Art. 6 para. 1 lit. b GDPR (implementation of pre-contractual measures and fulfilment of a contract).

5.3 After the end of the competition, your personal data processed as part of the competition will be deleted no later than three months after the end of the competition, unless you have given your effective consent for further processing and/or we have no legitimate interest in continuing to store it.

5.4 The applicable data protection law grants the data subjects the rights listed below:

Right to information in accordance with Art. 15 GDPR:

In particular, participants have a right to information about their personal data processed by us, the purposes of processing, the categories of personal data processed, the recipients or categories of recipients to whom their data has been or will be disclosed, the planned storage period or the criteria for determining the storage period, the existence of a right to rectification, erasure, restriction of processing, objection to processing, complaint to a supervisory authority, the origin of your data if it was not collected by us from you, the existence of automated decision-making including profiling and, if applicable, meaningful information on the logic involved and the scope and intended effects of such processing, as well as your right to be informed of the guarantees pursuant to Art. 46 GDPR if your data is transferred to third countries.

Right to rectification pursuant to Art. 16 GDPR:

Participants have a right to immediate rectification of incorrect data concerning you and/or completion of your incomplete data stored by us.

Right to erasure pursuant to Art. 17 GDPR:

Participants have the right to request the erasure of their personal data if the requirements of Art. 17 para. 1 GDPR are met. However, this right does not exist in particular if the processing is necessary for exercising the right of freedom of expression and information, for compliance with a legal obligation, for reasons of public interest or for the establishment, exercise or defence of legal claims.

Right to restriction of processing pursuant to Art. 18 GDPR:

Participants have the right to request the restriction of the processing of their personal data for as long as the accuracy of their data, which they dispute, is being verified, if they refuse to have their data erased due to unauthorised data processing and instead request the restriction of the processing of their data, if they require their data for the establishment, exercise or defence of legal claims after we no longer need this data after the purpose has been achieved or if they have lodged an objection for reasons relating to their particular situation, as long as it is not yet clear whether our legitimate reasons prevail.

Right to information in accordance with Art. 19 GDPR:

If a participant has asserted the right to rectification, erasure or restriction of processing against the controller, the controller is obliged to notify all recipients to whom the personal data concerning you have been disclosed of this rectification or erasure of the data or restriction of processing, unless this proves impossible or involves a disproportionate effort. Participants have the right to be informed about these recipients.

Right to data portability pursuant to Art. 20 GDPR:

Participants have the right to receive your personal data that you have provided to us in a structured, commonly used and machine-readable format or to request that it be transmitted to another controller, where technically feasible.

Right to withdraw consent granted in accordance with Art. 7 para. 3 GDPR:

Participants have the right to withdraw their consent to the processing of data at any time with effect for the future. In the event of revocation, we will delete the data concerned immediately, unless further processing can be based on a legal basis for processing without consent. The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal. Participation in the competition is no longer possible after withdrawal.

Right to lodge a complaint pursuant to Art. 77 GDPR:

If a participant considers that the processing of personal data relating to him or her infringes the GDPR, he or she shall have the right to lodge a complaint with a supervisory authority, in particular in the Member State of his or her habitual residence, place of work or place of the alleged infringement, without prejudice to any other administrative or judicial remedy.
